    www.jua.gr is the official website and online store (hereinafter the “Online Store” or “Jua”) for the display and sale of products (clothing and accessories) via the Internet, owned by the Greek company under the corporate name “JUA O.E.” and the trade name “JUA”, with registered offices at Pythagoras, No. 68, T.C. 55236, Panorama, Thessaloniki, Greece (VAT No: 802588777, 7th Tax Office of THESSALONIKI, General Commercial Registry (G.E.MI.) No 179143606000), email: info@jua.gr and customer service telephone numbers: +30 698 091 9323 / +30 699 370 8834 (hereinafter the “Business” or the “Store”).Through the website www.jua.gryou may obtain information regarding the products sold by the Business and, if you so wish, proceed with the remote purchase thereof, in accordance with these Terms of Use & Transactions and the applicable legislation. The maintenance of the website and the presentation of the products do not constitute a binding offer for the conclusion of a sales contract, but rather an invitation for you to submit an offer.
  2. Acceptance of the Terms of UseBefore accessing the Online Store and making use of its services, you are kindly requested to read these Terms of Use & Transactions carefully and ensure that you agree with them. In the event of disagreement with any term, you must refrain from any use of the Website and the Online Store, including simple browsing. Any User who accesses and transacts with the Online Store, or makes use, by way of example, of the newsletter services or proceeds with the purchase of products, shall be deemed to expressly and unreservedly consent to and accept the entirety of these Terms of Use & Transactions, without exception. Any User who purchases products through this website declares and warrants that they possess the legal capacity required by law (namely, that they are an adult and are not subject to legal guardianship).

Amendment of TermsThe Business reserves the right to unilaterally amend or update these Terms of Use & Transactions at any time, particularly where this is required by law or deemed necessary at its reasonable discretion, always within the limits of business ethics and the applicable law. Any amendment shall take effect from the moment it is published on this Website, unless otherwise provided by law. Any amendments shall not affect orders that have already been completed prior to their entry into force. Continued use of the website www.jua.gr following any amendment of the Terms shall constitute acceptance of the amended Terms.

Provision of InformationThe Business makes every possible effort to ensure that the information provided on this Website (in particular the information regarding the identity of the Business and the characteristics, prices and availability of the products) is complete, accurate, true and up to date. The above guarantees are subject to any technical or typographical errors which cannot be foreseen or have arisen unintentionally, or due to interruption of the operation of the Website or force majeure. The Business has taken all necessary measures to ensure that product availability and size information is updated as promptly as possible. However, it does not guarantee the absolute accuracy of the displayed stock quantities and available sizes, as updates to the relevant systems may require a reasonable period of time to be reflected on the Website following any change. In any event, an order confirmation email shall be sent informing you of any unavailability of products included in your order.
  5. Limitation of Liability
    1. Use of the Website www.jua.gr and any transaction carried out through the Online Store shall be at the User’s sole responsibility. The Business shall not be liable for any loss or damage suffered by the User or any third party as a result of:
      • the User’s failure to properly comply with these Terms of Use;
      • issues relating to the operation or use of the Website;
      • inability to provide services, products or information;
      • unauthorised interference by third parties with products, services or information made available through the Website.
    2. The Business shall not be liable for any damage arising from the cancellation, non-execution or delay in the execution of orders for reasons not attributable to the Business. The Business does not guarantee the availability of products but undertakes to inform the interested Customer in a timely manner of any unavailability. In such case, the Business shall bear no further liability.
    3. The Business makes reasonable efforts to maintain and ensure the availability of the Website. However, it should be noted that technical errors may occur (including, by way of example, in photographs, prices, texts, etc.) for reasons not attributable to the Business. In such cases, every effort shall be made to rectify them as promptly as possible. It is expressly agreed that the Business shall not be liable if, for any reason, the Website is unavailable at any given time or for any period of time.
    4. Hyperlinks (Links): The Website may contain hyperlinks to other websites. The Business bears no responsibility whatsoever for the content, terms of use or data protection policy of such websites, which the User accesses solely at their own responsibility.

Intellectual and Industrial Property RightsAll content of the Online Store, including, by way of example, trade names, trademarks, logos, images, graphics, photographs, designs, texts, products, etc., constitutes the intellectual and/or industrial property of the Business or third parties and is protected under Greek, European and international law. Any copying, reproduction, transfer, adaptation, republication, transmission, distribution or any other use of the content for commercial or other purposes is prohibited without the prior written consent of the Business or the respective rights holder. The names, logos and distinctive features describing the Online Store or the products/services of the Business or third parties constitute their respective proprietary assets and are protected under trademark law. Their appearance on the Website shall not be construed as granting any licence or right of use to third parties.
  7. User ObligationsThe User agrees to use the Website and the Online Store in accordance with the law, good faith and fair trading practices. In particular, the User undertakes not to use the Online Store for:

  8. Security – ConfidentialityThe Business has taken all necessary technical and organisational measures to ensure the confidentiality, integrity and availability of the User’s data. Such measures include, by way of example:

    • protection against viruses and malicious actions,
    • encryption (SSL certificate) for secure browsing and transactions.

    The Business shall not be liable for any damage that may arise due to the User’s failure to comply with the above security measures.

B. TERMS OF SALE

  1. Orders

    1. Completion – Order Confirmation
      Product prices include the applicable VAT. Prior to completing your order, the final payable amount will be displayed (product prices including VAT and any applicable shipping/cash-on-delivery charges). Before clicking “CONFIRM AND COMPLETE ORDER”, you will be informed that by placing your order you undertake the obligation to pay the total amount stated. If you agree, you may proceed by clicking the above button to submit your order to the Online Store. After submission, you will receive an automated confirmation email at the email address you have provided, containing detailed information regarding your order (products, prices, amounts, billing and delivery details, payment method, etc.). Once the order has been handed over to the courier company, you will receive, where available, a further email containing the tracking number, allowing you to monitor the progress of your shipment.
    2. Order Cancellation / Modification
      Order cancellation is possible:

      1. Before completion of the order
        You may technically return to your shopping cart and remove any product before clicking “CONFIRM AND COMPLETE ORDER”.
      2. After completion but before dispatch
        In the event of a significant delivery delay or for any other reason, you may request the cancellation of your order, provided that the products have not yet been handed over to the courier company for shipment; otherwise, the provisions on withdrawal shall apply (see Article 4 below). To request cancellation, the customer must send a relevant request to the Business by email at info@jua.gr or contact us by telephone at +30 698 091 9323 or +30 699 370 8834. Where the order has already been paid, the Business shall refund the payment without undue delay and no later than fourteen (14) calendar days from confirmation of the cancellation. Refunds shall be made by credit transfer to a bank account specified by the customer. Any bank transfer charges shall be borne by the customer.
      3. After receipt of the products
        • Refusal of receipt at the time of delivery may be considered an exercise of the right of withdrawal, provided that the procedure set out in Article 4 is followed.
        • Alternatively, you may exercise your right of withdrawal or your right to replacement/exchange (see Articles 4 and 5).
        • In the case of defective or incorrect products, the specific provisions of Article 6 “Liability for Defective, Incorrect or Lost Products” shall apply.
  2. Delivery of Products
    1. Method and Time of Delivery
      Shipments are carried out via a cooperating courier company.

      • Shipping within Greece:
        • Shipping cost: €3.50 for orders under €100
        • Free shipping for orders of €100 and above
        • Cash on delivery: additional charge of €2.

        Your order will be prepared within 1–2 working days from the date it is placed and will then be handed over to the courier company for dispatch. The estimated delivery time is 2–3 working days from dispatch (the above timeframes do not include Saturdays, Sundays, public holidays or the initial order processing stage). For remote or hard-to-reach areas, the delivery time is 2–5 days from handover to the courier company.

        In any case, the maximum legal delivery period is 30 calendar days from the conclusion of the contract, except in cases of force majeure.

      • Shipping to Cyprus:
        • Low-cost shipping: €11 with delivery in 6–11 days
        • Express shipping: €16 with delivery in 2–4 days
    2. Delivery Delays
      Delivery may be delayed in the following cases, by way of example:

      • if the product shipment is delayed on the part of the supplier (e.g. customs clearance issues, transport problems, force majeure),
      • if the product has been discontinued or is no longer available by decision of the supplier,
      • if force majeure events occur (e.g. extreme weather conditions, strikes, etc.).

      In such cases, we will contact you in order to:

      • deliver your order without the unavailable product, or
      • propose an alternative product, or
      • inform you of a new delivery timeframe.
  3. Payment methods
    The available payment methods on www.jua.gr are:

    1. Card Payment
      Debit/credit cards are accepted (including VISA, MasterCard, Maestro, VISA Electron, etc.). Transactions are carried out through a secure SSL environment of the cooperating bank/payment provider, and the Business does not store card details. Card details are used exclusively for the completion of the payment for the respective order.
    2. Bank Transfer
      You may deposit the order amount into one of the following bank accounts:

      2. Alpha Bank – IBAN: GR6701407200720002002020260 – Account holder: JUA O.E. (VAT No: 802588777)

      The order will be dispatched once payment has been confirmed. You are kindly requested to state your order reference number in the payment description in order to facilitate identification. Any interbank transfer fees shall be borne by the customer.

    3. Cash on Delivery
      Payment upon delivery of your order to your address, in cash to the courier company’s representative (applicable only for deliveries within Greece). An additional cash-on-delivery fee of €2.00 applies.
  4. Customer’s Right of Withdrawal
    1. Timeframe and Conditions
      You have the right to withdraw from the purchase contract without providing any reason within fourteen (14) calendar days from the day following the day on which you or a third party designated by you (other than the carrier) acquires physical possession of the goods. In the case of multiple goods ordered in a single order and delivered separately, the withdrawal period begins on the day following the receipt of the last item.
    2. Exercise of the Right
      To exercise your right of withdrawal, you must, before the expiry of the 14-day period, send the standard withdrawal form to the Business or submit a clear written statement of withdrawal to the company via email.
      The declaration may be sent:

      • by post to the registered office of the Business,
      • by email to info@jua.gr

      The withdrawal notice shall be deemed to have been received by the Business on the day following its receipt.

    3. Consumer Obligations
      You are required to return the goods without undue delay and in any event no later than fourteen (14) calendar days from the date on which the Business receives the withdrawal notice. The deadline shall be deemed to have been met if the goods are dispatched before its expiry. The cost of returning the goods shall be borne by you, unless otherwise agreed.
    4. Obligations of the BusinessIn the event of a valid exercise of the right of withdrawal, the Business shall reimburse all payments received, including the costs of the initial delivery (excluding any supplementary costs resulting from the customer’s choice of a delivery method other than the least expensive standard delivery offered), without undue delay and in any event no later than fourteen (14) days from the date on which it receives the returned goods. The refunded amount shall not include any cash-on-delivery charges. Refunds shall be made by credit transfer to a bank account you provide. Any bank transfer fees shall be borne by the customer. The Business may withhold reimbursement until it has received the goods and inspected their condition.
    5. Condition of Goods
      In order to be eligible for a refund, the following conditions must be met:

      • the goods must be in the condition in which they were received, unused, unwashed, and free from damage, stains, odours, etc.;
      • they must be returned in their original packaging with all labels, tags, stickers, etc.;
      • they must be accompanied by all relevant documents (receipt, invoice, etc.);
      • they must be accompanied by the completed return form included in the package you received.

      The Business does not accept products that do not meet the above requirements. In such cases, the products will be returned to you at your expense and the withdrawal shall be deemed as not having been exercised.

  5. Product Replacement / Exchange
    You have the right, within fourteen (14) calendar days from receipt, to request a product replacement (e.g. a different size or a different product). This process does not constitute a withdrawal, but an exchange. The exchange is subject to the condition that the product:

    • is returned in the same excellent condition in which it was received;
    • shows no damage, stains or odours;
    • has not been used or washed;
    • includes all original labels and tags;
    • is accompanied by the relevant purchase documents.

    The costs of returning the product and reshipping the replacement shall be borne by the customer, unless otherwise agreed.

    In the event of non-compliance with the above conditions, the Business shall not accept the exchange and the products will be returned to you at your expense.

  6. Liability for Defective, Incorrect or Lost Products
    The Business, as the seller, shall bear all obligations provided under the Greek Civil Code in relation to actual defects or lack of agreed-upon properties. In the event of a defective product or incorrect shipment (wrong product/size/quantity), you may:

    • request replacement with a new product,
    • exercise your right of withdrawal.

    In the event of a defective product or incorrect shipment, please contact us immediately at info@jua.gr and provide relevant photographs of the product and supporting documents, in order to ensure faster processing.

    The Business shall bear the cost of return and reshipment in cases of defective or incorrect products, provided that it has been informed in advance of the method of return and the relevant instructions have been followed.

    The risk of loss or damage to the products remains with the Business until the moment you or a third party designated by you (other than the carrier) acquires physical possession of the goods. If you choose a carrier of your own preference that is not recommended by the Business, the risk shall transfer to you upon delivery of the goods to the carrier.

  7. Final Terms
    1. Entire Agreement
      These General Terms constitute the full and exclusive agreement between the Business and the User regarding the use of the Online Store www.jua.gr and all transactions carried out through it, and supersede any prior written or oral agreements or arrangements.
    2. Waiver
      Any delay or failure by the Business to exercise any right arising from these Terms shall not constitute a waiver of such right, nor shall it prevent its subsequent exercise.
    3. Severability
      If any provision of these Terms is found to be invalid or unenforceable by a competent court or authority, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect. The Business shall replace the invalid provision with a valid one that is, to the extent possible, equivalent in effect.
    4. Applicable Law – Jurisdiction
      These Terms, the use of the Online Store, and all transactions carried out through it shall be governed by Greek law. Any dispute arising from or in connection with the sales contract and/or the use of the Online Store shall be subject to the exclusive jurisdiction of the courts of Thessaloniki, to which the parties hereby submit. The User also has the option to resort to Alternative Dispute Resolution (ADR) bodies or to the European Commission’s Online Dispute Resolution (ODR) platform.
